Rutledge v. PCMA and How it Will Affect Pharmacy

Pharmacy Times spoke with Ron Lanton, Principal at Lanton Law, about Rutledge v. PCMA and its impact on pharmacy and pharmacy benefit managers (PBMs).

Lanton discussed that there are 2 issues that come into play with the Rutledge v. PCMA case. While the official issue from the Supreme Court addresses if Arkansas is pre-empted by federal law and regulating PBMs, the other reason observed by Lanton questions if a PBM can operate without any oversight and run as an insurance company without being regulated as one.

Lanton also discussed what different states are trying to do for legislation for PBMs, recent changes to the court case, and what pharmacists and others watching the case should be prepared for while listening to the arguments.
